Electronic Real Estate Recording Task Force

Since 1998, the Minnesota County Recorders' Association (MCRA) has focused on the effect that recent trends in land development, mortgage financing, conveyancing, and other areas are having on Minnesota's land record system. In 1999 the MCRA passed a resolution calling for the creation of a broad-based group to study and address these issues.

In April of 1999, Senator Steve Kelley requested that Secretary of State Mary Kiffmeyer gather a group of interested parties including county recorders to meet on the subject of electronic real estate transactions. 

In the summer of 1999, they formed the Electronic Recording Study Group and expanded the number of stakeholders involved. The group discussed the introduction of information technology in the process of filing, recording, storing and retrieving real estate records in Minnesota's 87 county recording offices. The group included representatives from government, the real estate industry, the real estate bar, academia, and public and private-sector interest groups, and legislative staff.

The study group evolved into the Electronic Real Estate Recording Task Force (ERERTF) when the Legislature enacted Minnesota Laws 2000, Chapter 391 (effective August 1, 2000). The membership was expanded, and the task force was charged with  presenting a workplan and budget for conducting a study, which would make recommendations for the establishment of an electronic filing and recording system.

The task force submitted their Report to the Legislature in January 2001. The task force now must study and make recommendations regarding implementation of a system for electronic filing and recording of real estate documents, considering: (1) technology and computer needs; (2) legal issues such as authenticity, security, timing and priority of recordings, and the relationship between electronic and paper recording systems; (3) cost-effectiveness of electronic recording systems; (4) timetable and plan for implementing an electronic recording system, considering types of documents and entities using the system and volume of recordings; (5) permissive versus mandatory systems; and (6) other relevant issues identified by the task force.

The task force welcomes contributions that support its work. Contributions may include technical (e.g., computer, legal, or technical), computer software and hardware, training or financial support. If you are interested in providing support, please contact the project manager, Beth McInerny at Beth.McInerny@comcast.net.  Any contributions must be transferred directly to and remain in the sole control of the task force, Laws 2001, First Special Session, Chapter 10, Article 2, Section 100. Any proposal must be reviewed and approved by the executive committee of the task force.

Meetings of the ERERTF are open to the public, and notices and minutes of meetings will be posted on this Web site.

The task force will expire June 30, 2004.
